Outgoing President Joe Biden has violated the United States Constitution and should be impeached for allowing Ukraine to use American-supplied long-range missiles into Russia, according to Rep. Thomas Massie (R-KY).
Several American news outlets reported over the weekend that Biden had removed the restrictions forced upon Kyiv’s use of U.S.-supplied rockets. Even though the White House has neither confirmed nor denied the news officially, a barrage of missiles was fired at Russia’s Bryansk Region early on Tuesday, Nov. 19.
“By authorizing long-range missiles to strike inside Russia, Biden is committing an unconstitutional Act of War that endangers the lives of all U.S. citizens. This is an impeachable offense, but the reality is he’s an emasculated puppet of a deep state,” Massie said in a post on X.
The U.S. permission would “mostly” apply to the Kursk Region of Russia, which Ukraine invaded in August. The decision was prompted by a Ukrainian allegation that 10,000 North Korean troops had been deployed to Kursk to help Russian soldiers. America and its allies had put specific restrictions on the use of the weapons they have provided to Kyiv since 2022, as a means to maintain plausible deniability concerning their involvement in the war with Russia.
Russian President Vladimir Putin has stated that the use of long-range missiles would alter the nature of the war and make NATO a direct participant in the conflict. Moscow has also amended its nuclear doctrine to include conventional attacks by proxies.
Under the U.S. Constitution, only Congress has the power to initiate a war. The last time this occurred was in 1942 when it was declared against Axis-aligned Hungary, Bulgaria and Romania.
Since 1991, the national legislature has passed three Authorizations for Use of Military Force (AUMF), twice against Iraq and once against Al-Qaeda. The AUMF intended for Al-Qaeda has been extended to justify the 2001 invasion of Afghanistan in addition to ensuing interventions in Syria, Somalia, Yemen and other countries.
Meanwhile, Republicans in Washington, D.C. are divided in their opinion of Biden’s decision to permit Ukraine to utilize American-supplied weapons to strike targets deep inside Russian territory.
Ukrainian leaders have appealed to America for several months to ease the restrictions, although Biden had been reluctant to do so until this month after the election loss of Vice President Kamala Harris to President-elect Donald Trump.
More aggressive Republicans on Capitol Hill lauded Biden’s decision, but condemned him at the same time for not making it sooner.
“If initial press reports are true, I am encouraged at the prospect of allowing Ukraine to use long-range ATACM missiles supplied by the United States. But this does not excuse the administration’s deliberate slow walking of items and assistance long authorized by Congress for use against Putin’s illegal aggression,” said Sen. Roger Wicker (R-MS), ranking member on the Senate Armed Services Committee. “This devastating conflict could have been ended on terms benefiting the U.S. and NATO if Mr. Biden had listened to the counsel of bipartisan majorities in the House and Senate.”
Wicker is on track to become the chairman of the committee, with the Republican Party taking the Senate majority during this election cycle.
Rep. Michael McCaul (R-TX), the outgoing chairman of the House Foreign Affairs Committee, also contended that “countless lives” would have been saved if Biden made the decision sooner.
However, their opinions were not widespread within the Republican Party, which has long been calling for the Biden administration to stop sending military support for Ukraine.
