In an effort to protect Israeli Prime Minister Benjamin Netanyahu from facing an arrest warrant and indictment from the International Criminal Court (ICC), 12 United States senators sent an official letter to the Office of the Prosecutor of the ICC in The Hague, Netherlands, threatening retaliation if the court moves forward in prosecuting top Israeli officials for war crimes in Gaza.
Written on official U.S. Senate stationery, the letter, dated April 24, 2024, objects to any and all prosecution of Netanyahu and other members of the Israeli government, claiming the court has no jurisdiction over them.
“Target Israel and we will target you,” the letter threatens. “If you move forward with the measures indicated in the report, we will move to end all American support for the ICC, sanction your employees and associates, and bar you and your families from the United States. You have been warned.”
The letter is signed by the following U.S. senators:
Tom Cotton (R-Ark.)
Marsha Blackburn (R-Tenn.)
Ted Budd (R-N.C.)
Ted Cruz (R-Tex.)
Pete Ricketts (R-Neb.)
Rick Scott (R-Fla.)
Mitch McConnell (R-Ky.)
Katie Boyd Britt (R-Ala.)
Kevin Cramer (R-N.D.)
Bill Hagerty (R-Tenn.)
Marco Rubio (R-Fla.)
Tim Scott (R-S.C.)

The problem with the letter is that it appears to violate Title 18, United States Code, Sub-Section 1503, the relevant portion of which states that it is a crime for anyone to threaten via letter or communication to do things that prevent the due administration of justice.
The 12 aforementioned senators, all Republican, are in violation of federal law with their letter, which means all of them need to be prosecuted just as any other citizen would be for committing a crime.
While some sections of the law stipulate that offending actions worthy of prosecution are limited to those that occur within “Courts in the United States,” the above-mentioned section of the law does not contain that stipulation.
Not only did the 12 senators utter their threat in the United States where they feel they have immunity, but they also sent it to the ICC. Doing this establishes what one media source describes as “a sufficient factual nexus to invoke the jurisdiction of that court, and of The Netherlands.”
All 12 of the above-mentioned senators must be arrested, charged indicted, and criminally prosecuted right here in the U.S. for their crimes. Despite how they presumably perceive themselves, none of them is above the law.
“If the United States fails or refuses to arrest and prosecute these men, then the International Criminal Court should issue arrest warrants for each of them so that in the future, when these men travel to any country which is party to the ICC, they can be arrested in that country and extradited for trial,” the same media source reports.
“Ted Cruz occupies the position of representing me in the U.S. Senate,” one angry commenter wrote in response to the news. “However, I absolutely did NOT ask him to do this. I am beginning to think that NOBODY in politics represents me.”
Another responded with a question asking whether or not any of these 12 senators have bothered to “lift a finger to help American political prisoners who are rotting in American jails,” this referring to the January 6 “insurrectionists” who are still being denied due process under the law.
“Why is it that when Americans exercise their constitutional rights, they get arrested, sent to jail while senators who threaten the courts don’t?” this person further asked.
